Owners Corporations and Stratum Titles
Often Owners Corporation Managers who also manage Stratum Title Properties with Service Companies (instead of Owners Corporations) wonder about how to recover Service Company levies from shareholders who own units at the Stratum Title Property. Did you know this can be done through VCAT?
Stratum Titles (service companies)
Stratum Title Service Companies, unlike Owners Corporations are not governed by the Owners Corporations Act 2006, as is commonly assumed in the industry. Rather, Service Companies for Stratum Title Properties are governed by their Articles and Memorandum of Association and the Service Agreements with each shareholder.
Following the enactment of the Company Titles (Home Units) Act 2013 and on the basis of Australian Consumer Law principles, Tisher Liner FC Law have successfully recovered Service Company fees from shareholders in Stratum Title Properties through the Victorian Civil and Administrative Tribunal, in the Owners Corporations List.
